This site was developed for and published by British American Tobacco Denmark A/S (House of Prince A/S), located at Tobaksvejen 4, 2860 Soeborg in Copenhagen, Denmark, registered in the Trade and Companies Register under number CVR 1380 1134, (hereinafter called "BAT"). This site, available to address URL (hereafter the "Site") is dedicated to a competition, which joins the students of the whole world, it will be held starting in 1st December 2009until 30th February in 2010 (preliminary end date). If you wish to take part in this competition, we invite you to read the following terms of use.

To access and use this Site you must be an adult in your country and have a valid email address. If you are a minor, the permission of your parents will be required. You will be asked to fill out required fields in a form, identified as such by an asterisk. In this case, it is necessary that you complete these fields prior to your entry on the Site. Any inaccurate or incomplete registration will not be taken into account. For the pre-registration only a valid e-mail address is required and to name your native country. You acknowledge that any information that you provide to us are stored in our information systems is accurate and valid proof of your identity. Please notify us of any changes to your data. Access to the Site and / or some of its items may require the use of personal access codes. In this case, you must take measures to ensure the secrecy of these codes. You can of course change them at any time. However, the number of attempts to access the Site and / or some of its features could be limited to prevent fraudulent use of such codes. We invite you to inform us of any fraudulent use that you become aware of. We reserve the right to suspend your access to the Site should you fail to respect the rules described in these Terms of Use and the Rules of the Game. The Site and each of the elements (including, but not limited to, trademarks, name, logos, photographs, images, illustrations, text, video, etc.) are protected under BAT’s intellectual property rights. BAT and its beneficiaries do not grant any license or right other than to consult the Site for your participation in the Game. a. General obligations of the User Equipment (computers, software, telecommunication) allowing access to the Site are the sole responsibility of the User, are as telecommunications costs associated with their use. The User acknowledges having been informed that he/she cannot demand any compensation of any kind whatsoever on the part of BAT. Broadly speaking, the User agrees: To behave properly in the context of the use of the Site; To respect the intellectual property rights relating to the Site and each of its components. The User agrees not to use the Website in an illegal manner, and in particular not to create, perform, transmit, share, store or distribute through and / or the Website, harmful content, threatening, libellous, unauthorized, improper, abusive, harassing, vulgar, obscene, fraudulent, infringing the privacy and rights to the image, hateful, inciting violence, racial or ethnic hatred. Broadly speaking, the User agrees: To not access data that is not intended for his/her use. To not alter, modify, disrupt, hack or impair the security of the systems or servers connected to the Site. b. Topic Specific Stipulations BAT can make available to the User various topics on the site. These topics are subject to the conditions defined below. The User can carry out certain actions on the Site including (i) the online User content by the User.

a. General Provisions
BAT will strive to update the information contained on the Site. However, the User is informed that the transmission of data and information on the Internet has only a relative technical reliability, these circulating on networks of heterogeneous nature. Therefore, BAT does not guarantee the accuracy of data contained on the Site, including but not limited to, the information contained in the heading "Dashboard."

c. Tips
The available tips that may be provided on this Site are simple simulations designed to allow better monitoring of performance of the User. The information they can deliver is purely indicative and can never replace human follow-up. BAT does not guarantee the satisfaction of the User's use of the tips resulting from the use of these tools and assumes no liability for the use that the User could do with them.

d. Hyperlinks on the Site
The hypertext links on the Site may lead Users to the websites of different Users. As such, it is clear that BAT has not reviewed all sites that may be connected to his, their content and information that are present, and declines any responsibility for the content of these sites and on the use that could be made by the User. The use of such sites by the User is his sole responsibility. In addition, the User agrees not to create links to this Site without the prior written permission of BAT.

BAT to collects and controls personal data about the User. This personal data will be processed automatically and can be used in particular to manage access to certain items and conservation of the results of progress of the Users personal space. BAT has taken appropriate measures, such as encoding, during the gathering of personal information to prevent, as far as possible, any unauthorized access. BAT undertakes not to communicate to third parties, although we may share the data with other BAT entities for the use in recruitment purposes only. By participating in the Game, the Students shall have access to information and various kinds of knowledge, in particular, commercial, financial, scientific, industrial or marketing information, concerning the activities, operations and studies of BAT, one or several of the companies in the BAT Group or one or several companies with which they are or were related or in which they are interested. The Students shall also have access to information concerning individuals belonging to the above-mentioned companies (hereinafter called the "Information"). The Students shall take the measures necessary to keep the Information strictly confidential, except for the Information that has already fallen into the public domain. The Students acknowledge that the disclosure of the Information would be likely to cause the BAT Group considerable damage, permitting BAT to engage their liability. The confidentiality obligation shall continue after the end of the Game, for any reason whatsoever, until such time as the object of this clause ceases to exist.

In general, the website and all its contents are brought without warranty of any kind. BAT declines any possible warranty, explicit or implicit, more particularly the warranty of adaptation to a specific or non-counterfeited use. The user accepts that the utilisation of the site or any section is at the users own risk. In Particular, BAT does not guaranty that the site or section (i) will fulfil the expectations of the User, (ii) that the site will be efficient, precise, uninterrupted, punctual, secured, without any risk of error or availability, (iii) that the given information, date, contents and documents which could be obtain from the section will be precise or reliable and (iv) all the errors that will damage the section will be corrected.

The User agrees to compensate, to not held accountable and defend BAT and its affiliates against any claim, demand, losses or liability, including court costs and attorney fees, if action in question is based upon, or otherwise depends on an act of violation of the Terms of Use by the User or any other person using his access codes.

In general, BAT declines all responsibility towards the User concerning eventual damage to the site, an impossibility to use the site and/or its sections, the contents, the publicity, and the available products on or from the sites linked to the website. In any way, BAT or its affiliates will not be held accountable of the damages that could lead to the credit given to the available information on the site or of their utilisation. BAT and its affiliates will not be held accountable, explicitly or implicitly, if the use of the information leads to a non respect of the rights of a third party and particularly but without a certain extent, a patent, a brand and/or the rights of the owner. BAT will also not be held accountable in case of technical deficiency, anomaly of the material, and the software of any kind (Virus, etc…) on the Users system. BAT will also not be held accountable to the Users own material and to the saved data and/or to the consequences of the Users personal, professional, and commercial activities. The accountability of BAT concerning any damage following the use of the site or its sections by the User could not be engaged in any way. Therefore, the accountability of BAT could not be engaged in any case of incompatibility of the site and/or each or some sections with the technical environment of the User. BAT reserves the right to modify or disrupt temporarily or definitively each or some of its sections without prior notifications. The User is aware that BAT will not hold the User or a third party accountable for any modifications or interruptions of the section. The User recognizes all the information concerning the technical specifications of the Site, of its functions and of its User requirements.

BAT reserves the right to change the Terms of Use. Any modification of the Site will be incorporated into the Terms of Use.

The Terms of Use are subject to the laws of Denmark. Any dispute concerning the validity, interpretation and / or enforcement of the Terms of Use fall within the jurisdiction of courts of competent jurisdiction in Denmark. However, BAT and the User acknowledge and agree that whether the claim was related to Intellectual Property, BAT would then be entitled to sue the dispute before the competent civil court. The User acknowledges and agrees that the foregoing paragraph will in no way impede the rights of BAT to undertake any relief and / or measure before any competent court.
